LIMIT OF LIABILITY

 

In consideration of the transportation charges for the movement of this shipment, it is agreed that the liability of AEROMARINE shall be limited in any event to the sum of US$100.00, unless insurance cover is arranged in writing in advance. AEROMARINE  does not agree to carry, and it is agreed that AEROMARINE  accepts no liability for items of unusual intrinsic value such as CASH, NEGOTIABLE SECURITIES, JEWELS, FURS or the like. Contents of packages should not exceed US$500.00.

 

LIABILITIES NOT ASSUMED

 

AEROMARINE  is not liable for any loss miss-delivery or non-delivery caused by the act default or omission of the shipper, consignee or other party who claims interest in the shipment the nature of the shipment or any defect thereof violation by the shipper or consignee of any of the TERMS contained in the way bill including but not limited to improper or insufficient packing, securing marking or addressing or failure to observe any of the rules relating to shipments not acceptable for transportation or shipments acceptable only under certain conditions, acts of God, perils of the air, public authorities acts of omissions of the customs or quarantine officials war, riots, strikes or other labor disputes weather conditions or mechanical delay of aircraft or other equipment compliance with delivery/instructions from the shipper or consignee or acts of omission of any other person other than AEROMARINE.

 

AEROMARINE CANNOT GUARANTEE DELIVERY BY A SPECIAL TIME OR DATE AND SHALL NOT BE LIABLE FOR ANY DAMAGE DUE TO DELAY.

 

IN ANY EVENY AEROMARINE SHALL NOT BE LIABLE FOR ANY SPECIAL INCIDENTAL OR CONSEQUENTIAL DAMAGES INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS OR INCOME WHETHER OR NOT WE HAD KNOWLEDGE THT SUCH DAMAGES MIGHT BE INCURRED

 

UNDELIVERED PACKAGES

3. If a shipment is undelivered the sender will be notified. Upon the sender’s instruction the shipment will be held for pickup or returned to the sender. If the shipment is returned, the sender will be billed for the applicable return charges. If no instructions are received from the shipper within 60 days from the date of the shipment AEROMARINE  will dispose of the shipment at a public private sale.

 

CLAIMS

4. No claim for loss or damage to a shipment will be entertained until all transportation charges thereon have been paid. The amount of claims may not be deducted from transportation charges.

Written notice of any claims for loss, damage or non-delivery must be reported to AEROMARINE  by sender within 90 days after acceptance of the shipment for carriage. Notice of concealed damage or concealed shortage must be reported in writing within 15 days of delivery with privilege to AEROMARINE to make inspection of the shipment. All such merchandise must be retained in the original shipping container until AEROMARINE  may make an inspection thereof.

 

5. RIGHT OF INSPECTION

AEROMARINE  reserves the right to open, examine and/or refuse any shipment both for customs and/or security purposes.

 

6. No restricted articles as defined by IATA restricted articles tariff, can be accepted for carriage within courier baggage and such can only be transported as air freight under the procedures and restrictions out in the IATA tariffs.
